These terms govern your use of the Screenshot Suite Chrome extension and this website, both published by Holvine, LLC, a Delaware limited liability company. Screenshot Suite is currently offered free of charge, with a limited license to use it and standard warranty and liability terms below.

Who provides Screenshot Suite, and what do these terms cover?

Screenshot Suite (the Chrome extension, this website, and related services) is provided by Holvine, LLC, a Delaware limited liability company, at 131 Continental Dr, Suite 305, Newark, DE 19713, United States. By installing, accessing or using Screenshot Suite, you agree to these terms; if you do not agree, do not use it. Contact: contact@screenshotsuite.com.

What does Screenshot Suite do?

Depending on the version, Screenshot Suite lets you capture the visible portion of a page, an entire page, a selected area, or a video frame; capture a screen; record a browser tab or a screen/window, with audio; annotate what you capture; keep a local history of recent captures; and export screenshots and recordings to your device. Features may change as we improve, update or modify the Service.

Who can use Screenshot Suite?

You may use the Service only if you are legally capable of entering into a binding agreement under the laws that apply to you. If you use it on behalf of an organization, you confirm you have the authority to accept these terms for that organization.

What license do you get to use Screenshot Suite?

Subject to your compliance with these terms, Holvine grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Screenshot Suite for its intended purposes, for personal or commercial use. This license does not transfer ownership of the Service or any intellectual property rights to you.

What are you not allowed to do?

Except where applicable law expressly permits it, you may not: copy, modify or create derivative works of the Service; reverse engineer, decompile or disassemble it, or attempt to obtain its source code; circumvent or disable its technical or security features; resell, sublicense, rent, lease or redistribute it as a standalone product; remove copyright, trademark or other proprietary notices; interfere with its operation, security or integrity; use it to distribute malware or other harmful material; use it unlawfully; or use it in a way that violates the rights of others. Nothing here restricts a right that cannot lawfully be restricted.

Who owns your content?

You do. Screenshot Suite processes captures and recordings in your browser and does not upload them, and Holvine claims no rights over them. You are solely responsible for the content you capture, record, annotate, export, store or share using the Service, and you confirm you have all the rights, permissions and authorizations needed to do so.

What should you know about screen and audio recording?

Recording another person, a conversation, copyrighted material, confidential information or other protected content may be subject to legal restrictions. You are solely responsible for determining whether your use of the recording functionality is lawful and whether consent or authorization is required. Holvine does not provide legal advice on recording, privacy, copyright, confidentiality or consent requirements.

Where is your capture content processed?

Screenshot Suite is designed to process screenshots, recordings, annotations and related capture content locally on your device; under its current architecture, this content is not uploaded to Holvine’s servers, and no Holvine account or registration is required. Certain preferences may sync through Chrome Sync if you enable it, but your capture content does not. See the Privacy Policy for details.

What happens to your local history and exported files?

Screenshot Suite may keep a local history of your 30 most recent captures, accessible only through the extension on that device; Holvine keeps no server-side copy of it, and uninstalling the extension or clearing browser data may delete it. Exported files are saved to your device through your browser’s download functionality, generally to your Downloads folder; once exported, they are under your control, and Holvine is not responsible for how you subsequently store, share or use them.

Is Screenshot Suite free?

Screenshot Suite is currently offered free of charge. If Screenshot Suite ever offers a paid plan, we will update these terms, with a new date, before it launches.

Can the Service change, or become unavailable?

We may modify, update, suspend or discontinue features over time (adding or removing functionality, improving performance or security, fixing bugs, or adapting to browser, OS or legal requirements) and do not guarantee that any particular feature remains available indefinitely. We make reasonable efforts to keep the Service running, but do not guarantee it will always be available, uninterrupted, error-free, compatible with every website, browser configuration or future Chrome version, or that it will preserve every capture in every circumstance.

Do you rely on third-party services?

Screenshot Suite operates within Google Chrome and may depend on browser APIs, operating-system functionality, the Chrome Web Store and other third-party services, each governed by its own terms and privacy policy. Holvine does not control, and is not responsible for, third-party services, including their availability or changes.

Is there a warranty?

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” HOLVINE DISCLAIMS ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS NOT EXPRESSLY PROVIDED IN THESE TERMS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. HOLVINE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE OR SUITABLE FOR YOUR PARTICULAR PURPOSE. YOU ARE RESPONSIBLE FOR MAINTAINING APPROPRIATE BACKUPS OF YOUR FILES AND CONTENT. Nothing in these terms excludes or limits a warranty or consumer right that cannot lawfully be excluded or limited.

What is the limit of our liability?

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOLVINE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE: INCLUDING, TO THE EXTENT PERMITTED BY LAW, LOSS OF DATA, FILES, PROFITS, REVENUE, BUSINESS OPPORTUNITIES, BUSINESS INTERRUPTION OR EXPECTED SAVINGS. HOLVINE’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US$100, OR (B) THE TOTAL AMOUNT YOU PAID HOLVINE FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Nothing in these terms limits or excludes liability that cannot legally be limited or excluded.

Do you indemnify Holvine?

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Holvine and its members, officers, employees, contractors and service providers from claims, liabilities, damages, losses and reasonable expenses arising out of or relating to your use of the Service in violation of these terms, your violation of applicable law, your infringement of a third party’s rights, content you capture, record, modify or distribute using Screenshot Suite, or your unauthorized use of the Service.

Can the Service be suspended, or can you stop using it?

You may stop using Screenshot Suite at any time by uninstalling the extension. Holvine may suspend, restrict or discontinue the Service, in whole or in part, where reasonably necessary for security, legal, technical, operational or abuse-prevention reasons. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution) continue to apply after the Service ends for you.

Can these terms change?

Yes. We will update the “Updated” date above and, where required by applicable law, give additional notice of material changes. Continuing to use Screenshot Suite after revised terms take effect means you accept them, to the extent the law allows.

Which law applies?

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, and any dispute is subject to the jurisdiction of the competent courts of Delaware, except where applicable law gives you the right to bring proceedings elsewhere. Nothing here limits a mandatory consumer-protection or jurisdictional right you have under the law of your own country or place of residence.

What if part of these terms turns out to be unenforceable?

That provision will be enforced to the maximum extent the law allows, or modified to the minimum extent necessary to make it enforceable; the rest of these terms remain in effect. Our failure to enforce a provision at any point does not waive our right to enforce it later.

Do these terms cover everything between us?

These terms, together with the Privacy Policy and any additional terms expressly incorporated by reference, are the entire agreement between you and Holvine about your use of Screenshot Suite, and supersede any prior agreement on the same subject, except where the law says otherwise.
